Software End User License Agreement
Ownership
Title to the enclosed programme (the Software) and all copies thereof remain with Webtechserve or its vendors. The software is copyrighted and is protected by (India) copyright laws and international treaty provisions. You will not remove or alter the copyright notice from the Software. You agree to prevent any unauthorized copying of the Software for any users of this Software.
Important
Please read Terms and Conditions of this license carefully before opening this package. By opening this package, you indicate that you agree to be bound by the following Terms and Conditions, which include the Software license and limited warranty provisions. If you do not agree with the following Terms and Conditions, return the unopened package and any accompany items to Webtechserve. within thirty (30) days of acquisition for a full refund. Please note that any use of the Software in contravention of the copyright laws of India and other relevant international treaties which may constitutes an offence.
License
Webtechserve. grants you the right to use enclosed program (Software). You will not use, copy, modify, rent, sell or transfer the Software or any portion thereof except as provided for in this Agreement.
Grant
This license allows you to:
1. Use the Software on a single computer.
2. Copy the Software solely for Verification of Emails.
Limitations of Use
You will not:
1. Sublicense the Software;
2. Reverse engineer, decompile, or disassemble the Software;
3. Copy the Software except as provided in this Agreement;
Warranty
Webtechserve. warrants that it has the right to license you to use the Software. Webtechserve.
Webtechserve's entire liability and your exclusive remedy shall be the replacement of the Software.
Except as provided above, the Software is provided AS IS without warranty of any kind.
Limitation of Liability
Except for the above warranties no further warranty of any kind, either express or implied, or warranties of merchantability or fitness for any particular purpose is given and any warranty except for the above warranties are hereby excluded. Neither Webtechserve. nor its vendors shall be liable for any loss of profits, loss of use, interruption of business, nor for indirect, special, incidental, or consequential damages of any kind.
Audit
Webtechserve. reserves the right to conduct or have conducted audits to verify your compliance with this Agreement.
Termination of this License
Webtechserve. may terminate this license at any time if you are in breach of any of its terms or conditions. Upon termination, you shall immediately destroy the Software or return all copies of the Software to Webtechserve. along with any copies you have made or comply with such other instruction from Webtechserve. Termination shall not affect the rights of Webtechserve. to bring any action against you.
Entire Agreement
This Agreement represents the entire understanding and agreement of the parties and supersedes all prior communications, agreements and understandings relating to the subject matter hereof.
Applicable Laws
You must not sell, transfer, export or re-sell for export to any party, this Software for use directly or indirectly, or if you have grounds for suspecting that this Software is intended to used for any purposes, related to mass destructive weapons or missiles technology. This Agreement is governed by the laws of the Republic of India, including patent and copyright laws. Any claim arising out of this Agreement will be brought in the Republic of India and in this regard, all parties will submit to the non exclusive jurisdiction of the Indian Courts.
